Under the Family and Medical Leave Act , the following will be considered qualifying events for which the employee can take unpaid leave:
- Serious health condition of the employee or immediate family member (the FMLA has very specific criteria as to what qualifies as a serious health condition )
- To care for a child within one year of birth
- Adoption of a child or placement of a foster child at home
- Serious illness of a covered service member if the employee is the immediate family member or next of kin of the service member.
An eligible employee is entitled to have up to 26 work weeks of FMLA leave to care for the serious illness of a covered service member provided he/she is the son, daughter, spouse, parent or next of kin of a covered service member.
It’s not just the employee who benefits under the FMLA, but the employer as well.
