The following are the eligibility criteria to claim Paid Family Leave Program (PFL) benefits:
- He/she must pay in to the SDI funds in order to get the PFL benefits
- He/she must have at least USD 300 in wages in the base period
- He/she must obtain a medical certificate from the registered healthcare provider that establishes serious health condition
- Application must be submitted not earlier than nine days prior to and not later than 49 days post the first day of a leave begins
Following individuals are ineligible for Paid Family Leave benefits :
- A worker who is claiming and receiving unemployment insurance or disability insurance benefits
- An individual who is receiving workers’ compensation benefits at a weekly rate equal to or greater than the PFL rate
- An employee who doesn’t undergo independent medical examination when requested to do so
An eligible individual will receive partial pay insurance benefits for the following reasons:
- To care for a seriously ill immediate family member (spouse, parents, child or registered family member).
- For his/her own serious health conditions
- To bond with a new born baby or adopted or foster child in the first year of birth, adoption or foster care.
In a 24 hour period, up to three eligible individuals may receive PFL benefits to provide care for the same care recipient. Serious health conditions include the illness, injury, impairment, physical or mental conditions that involves inpatient care in a hospital, hospice, or residential medical care facility.
