Firms marketing beverages must be conscious of both the labeling and marketing requirements of FDA and FTC, as well as practical considerations for risk mitigation from consumer class action law suits. As consumers’ demand for healthy, “functional” and flavorful products has increased, firms must ensure that their beverages are labeled and advertised in a manner that complies with federal regulatory requirements and that their claims are substantiated with appropriate data.
This session is designed for food manufacturers and labelers and is focused towards helping both domestic and foreign entities in ensuring compliance with FDA and FTC regulations. The webinar will provide the requirements for juice labeling, health claims, “natural” claims and provide an update on the FDA’s regulation of caffeinated beverages. Case studies will be presented, as well as an update on recent enforcement activity. Finally, the webinar will discuss recent civil litigation involving beverage marketing.

Tony Pavel, is a Partner in the Food and Drug Practice at Morgan Lewis & Bockius. Mr. Pavel has a broad range of experience with issues including food safety, labeling, GRAS self-affirmations and notifications. He assists clients with novel food additive petitions, product claims in labeling, advertising, and other promotional material, as well as clinical research and substantiation issues, and regulatory strategies for new product development. Mr. Pavel is the past Chair of the Institute of Food Technologists Food Laws and Regulations Division and current Chair of the DC Section. During Mr. Pavel's undergraduate and legal studies, he worked for a food HACCP consulting business.
