Harper Government’s Consumer Product Safety Act Receives Royal Assent

A new Canadian law came into effect after receiving the Royal Assent - the Canada Consumer Product Safety Act (CCPSA). The federal Minister of Health, Honorable Leona Aglukkaq stated, "I am delighted our Government's Consumer Product Safety Act is now the law of the land," said Minister Aglukkaq. "This will give the Harper Government important new tools to deliver stronger, more effective protection for Canadian consumers and their families."
The CCPSA proposes to protect Canadians’ health and safety better by implementing safety requirements for consumer products, mandatory reporting of serious incidents or defects, quick corrective action for the discovery of dangerous objects by triggering recalls, consequences for non-compliance, prohibits the manufacture and sale of dangerous products, necessitates appropriate information display on products, prohibits packaging/labeling containing false/misleading information relating to health or safety, etc.
Transition from Hazardous Products Act to CCPSA
The general mandate, under the Hazardous Products Act, includes "any product, material or substance that is or contains a poisonous, toxic, flammable, explosive, corrosive, infectious, oxidizing or reactive product... (which) is or is likely to be a danger to the health and safety of the public; or any product designed for household, garden or personal use, for use in sports or recreational activities, as lifesaving equipment or as a toy, plaything or equipment for use by children... (which) is or is likely to be a danger to the health or safety of the public because of its design, construction or contents."
The next few months will witness the implementation of the CCPSA through an accelerated plan. The transition will be from the previous Hazardous Products Act, a 40-year-old safety law. Bill C-36 (CCPSA) was proposed to modernize and strengthen the law and keep Canadians safe from certain types of hazardous domestic and imported consumer products. The CCPSA will replace Part I of the Hazardous Products Act thus regulating dangerous consumer products and enhancing the current Act.
