Recall of Tainted Canned Chicken Salad Products by Illinois-based Suter Company

The recalled products include:
- 8.2 – ounce packages of “Bumble Bee lunch on the run chicken salad complete lunch kit" con-taining Bumble Bee Chicken Salad along with crackers, mixed fruit, a cookie and a spoon. The product package carries a "Best-by" date of 07/11.
- 3.5 – ounce packages of "Bumble Bee chicken salad with crackers" containing Bumble Bee Chicken Salad and crackers. The product package carries a "Best-by" date of 01/12 or 02/12.
The cans of chicken salad bear the establishment number "P-169" inside the USDA mark of inspection and the lot code "0225XXQBC". The U.S. Department of Agriculture's (USDA) Food Safety and Inspection Service (FSIS) re-issued Recall Release RC-064-2010, upon receipt of additional information from the recalling firm to correct the "Best-by" date so consumers can confirm they no longer possess the recalled products. This is a Class II recall where there is a health hazard situation with a remote probability of adverse health consequences from the use of the product.
FDA Regulations
Section 305 of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (the Bioterrorism Act) (PL 177-188) requires owners, operators, or agents in charge of domestic and foreign facilities that manufacture, process, pack, or hold food for human or animal consumption in the United States to register their facilities with FDA by December 12, 2003, unless exempted. A domestic facility must be registered whether or not food from that facility enters interstate commerce. Facilities getting into the said activities after December 12, 2003, must be registered with FDA before commenc-ing such activities.
The Federal Food, Drug, and Cosmetic Act (FD&C Act) and the Fair Packaging and Labeling Act are the Federal laws governing food products under FDA's jurisdiction. Also, The Nutrition Labeling and Educa-tion Act (NLEA), which amended the FD&C Act requires most foods to bear nutrition labeling and re-quires food labels that bear nutrient content claims and certain health messages to comply with specific requirements.
