Did you know the largest back pay awards and fines are generated because of improper classification of exempt worker and non-compliance with regulations? For any employer, exempt employee classification and compliance infractions can be devastating or ruinous. As if the requirements for exempt classification were not confusing enough, the Department of Labor is now proposing new regulations to determine what employees may qualify for overtime pay.
Though the regulation may be getting more confusing it is becoming even more important that employers and employees understand the requirements for classifying an employee as exempt. Being classified as exempt is not just about how much a person is paid but is also related to the duties. It is a healthy combination of pay and duties that determine if a person is exempt or non-exempt. The next step in the process is determining what it means to be an exempt employee: what can the employer expect and what can the employee request as it relates to work hours and compensation.
In this 90 minute session, attendees will learn the requirements for an exempt classification, the consequences for improper classification as well as recent DOL proposed changes to the salary requirements for exempt status.
