California Family Rights Act (CFRA) leave benefits are applicable to both eligible employees and employers .
CFRA leave benefits for Employer:
Employees can only take pregnancy disability leave only if:
- He/ she is not required to pay to an employee during the CFRA leave period except when an employee elects to use accrued vacation time or accumulated paid leave.
- If the CFRA leave is for the employee’s own serious health condition the employee can use any accumulated paid leave or any other accrued vacation time.
- During the period of CFRA leave, the employee must get all the health benefits that the employer provides. An employer has the obligation to continue providing all the health benefits to the employee during CFRA leave.
- The employee has the right to enjoy all the employee benefit plans including life, disability or accident insurance, pension plans, unemployment benefit plans to the same extent as would apply to any other leave granted by the employer.
The California Family Rights Act has very specific criteria for calculating leave as well as duration and notification requirements.
